3. Legal basis for data processing

Until May 24, 2018, we are subject in particular to the provisions of the current Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).
From May 25, 2018, the European General Data Protection Regulation (GDPR) will apply.
According to Art. 13 para. 1 lit. c GDPR, we must also inform you about the legal basis for data processing on our website and the purposes of the respective data processing. The data processing on our website is permitted by two different legal bases in addition to the granting of consent: According to Art. 6 para. 1 sentence 1 lit. b GDPR (or according to § 28 para. 1 sentence 1 no. 1 BDSG), data processing is lawful if it is necessary for the performance of a contract to which the data subject is a party or for the implementation of pre-contractual measures taken at the request of the data subject.
Pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR (or pursuant to Section 28 para. 1 sentence 1 no. 2 BDSG), data processing is also lawful if it is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

 

4. Collection and storage of personal data and the nature and purpose of their use a) When visiting the website When you visit our website www.bdf-berlin.de, the browser used on your device automatically sends information to the server of our website.
The website is hosted on servers of the web space provider domainfactory GmbH, Oskar-Messter-Str. 33, 85737 Ismaning, Germany, Tel: +49 89 998 288 026, Fax: +49 89 55 266 222, Email: support@df.eu. The server is located within the European Union, in Strasbourg. When you visit our website, the following data transmitted by your browser is automatically collected and stored until it is automatically deleted: IP address of the requesting computer, date and time of access, name and URL of the retrieved file, website from which access is made (referrer URL), browser used and, if applicable, the operating system of your computer and the name of your access provider.
This data is processed for the following purposes: Ensuring a smooth connection to the website, ensuring convenient use of our website, evaluating system security and stability, and for other administrative purposes.
DomainFactory uses the web analysis software “Webalizer” to statistically evaluate user access. “Webalizer” creates statistical overviews based on the data, for example on the number of page views. These evaluations are not merged with other data sources, in particular with personal data. No log files are stored.
The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your person. b) When using our contact details We offer you the opportunity to contact us via the email and postal addresses provided on the website. We use the data you provide (e.g. name, address, telephone number, email address, etc.) to process the contact on the basis of Art. 6 para. 1 lit. a GDPR (§§ 4a BDSG, 13 para. 2 TMG). If necessary, your contact details will then be entered into a data processing program. This is how we record the contact details of interested parties and partners. This data is stored to enable us to maintain the relationship with our partners and other interested parties. The legal basis for this data processing is Art. 6 para. 1 lit. f GDPR (or Section 28 para. 1 sentence 1 no. 2 BDSG).

5. Other data uses Further processing and use of your personal data will generally only take place if this is permitted by law or if you have consented to the data processing or use. In the event of further processing for purposes other than those for which the data was originally collected, we will inform you of these other purposes prior to further processing and provide you with further relevant information.

6. Data erasure In general, we erase or anonymize your personal data as soon as it is no longer required for the purposes for which we collected or used it in accordance with the preceding paragraphs. Specific information on the retention and deletion of personal data in the previous sections remains unaffected. Unless this Privacy Policy contains other, deviating provisions regarding the storage of data, the data collected by us will be stored by us for as long as it is required for the aforementioned purposes for which it was collected.

8. Right to information You have the right to receive information about the personal data stored about you at any time. 9. Further rights of data subjects As a data subject, you have the following further rights against us: right to rectification of inaccurate personal data concerning you in accordance with Art. 16 GDPR; right to immediate erasure (“right to be forgotten”) of personal data concerning you if there are legal grounds in accordance with Art. 17 GDPR. These legal grounds include if the personal data are no longer necessary for the purposes for which they were originally collected / processed, if you have withdrawn your consent and there is no other legal basis for the processing or if you object to the processing and there are no overriding grounds for processing; right to restriction of processing if the conditions are met and in accordance with Art. 18 GDPR. Accordingly, processing may be restricted, inter alia, if the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead, or if you have objected to processing pursuant to Article 21(1) GDPR pending the verification whether our legitimate grounds override yours; right to object to data processing pursuant to Article 21 GDPR concerning data relating to you which is based on point (e) or (f) of Article 6(1) GDPR; this also applies to profiling based on these provisions. We will then no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims; right to data portability pursuant to Art. 20 GDPR. Right to lodge a complaint with the competent supervisory authority You have the right to lodge a complaint with a supervisory authority at any time, in particular with a supervisory authority in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR or the BDSG.
